DEFINITIONS
In this Privacy Statement:
Act means the Privacy Act 1988 (Cth);
PTG Group or we or us or our means Protest Geotechnical Pty Ltd T/A PTG Group, Protest Software Pty Ltd ACN 624 615 194 and its Related Bodies Corporate.
 
OAIC means the Office of the Australian Information Commissioner (https://www.oaic.gov.au/);
Personal Information has the meaning given to that term in the Act. In general terms, this includes information or an opinion, whether true or not and whether recorded or not, that personally identifies you either directly (e.g. your name) or indirectly (e.g. identification number, location data or online identifier);
 
Sensitive Information has the meaning given to that term in the Act. In general terms this includes information or an opinion about a person’s race or ethnicity, political opinions, memberships or associations, religious belief or affiliations, philosophical beliefs, sexual orientation, criminal record, health or genetic information, or biometric information;
 
You or your means the person or entity who is interacting with us (for example using our website(s), communicating with us, or engaging in business dealings with us) and includes any representatives or agents.
 
Unless context otherwise requires, in this Privacy Statement, all references to Personal Information include Sensitive Information.
 
WHAT PERSONAL INFORMATION DO WE COLLECT?
The Personal Information we collect about you depends on the nature of your dealings with us or what you choose to share with us. The Personal Information we collect about you may include:

  1. personal/contact details

  2. information obtained when onboarding you/your business as a client, supplier, or subcontractor;

  3. financial information, including billing and payment details;

  4. information relating to your job application or pre-employment screening;

  5. information obtained as a result of credit checks;

  6. CCTV footage or still images captured at our offices or otherwise captured in the course of business
     

We may collect various other types of Personal Information, including Sensitive Information, in the course of conducting our business where it is provided by our clients, suppliers, or other persons without being solicited. When reasonably necessary, we may also collect Personal Information indirectly from publicly available sources or third parties such as authorised representatives or agents, government agencies, or the internet.
 
We will act reasonably and adhere to set guidelines to ensure that our collection of Personal Information is fair and lawful. Specifically, we:

  1. Collect only as much Personal Information as is required by law or needed for reasonable and legitimate business purposes;

  2. Collect Personal Information in a non-deceptive manner;

  3. Where appropriate, inform individuals which Personal Information is required, and which is optional at the time of collection;

  4. Collect Personal Information from individuals consistent with local legal requirements


HOW WE COLLECT YOUR PERSONAL INFORMATION?
We may collect Personal Information from you when:

  1. you access or use our website, social media, online application or contact channels. In particular, when entering your Personal Information to register as a client or supplier via theBOSSapp or any other onboarding software we may use;

  2. you communicate with our employees or clients;

  3. you deal with us in the course of our business; and

  4. we solicit it from third party or publicly available sources or receive information in the course of our business, for example credit or solvency checks.
     

If we solicit Personal Information, we will generally solicit it directly from the person it relates to or their employees or agents, unless it is unreasonable or impracticable for us to do so.
 
HOW WE STORE AND PROTECT PERSONAL INFORMATION
We may hold Personal Information in electronic form. Electronic files are only accessible through our secure network.
 
We take reasonable steps to:

  1. ensure that the Personal Information we collect is accurate, up-to-date, complete and relevant, other than where it is only collected to provide a service or advice in respect of a particular point in time, in which case we will seek to ensure it is accurate, complete and relevant as at that particular point in time;

  2. ensure that Personal Information we use or disclose is accurate, up-to-date, complete and relevant, having regard to the purposes for which Personal Information is used or disclosed; and

  3. protect Personal Information from misuse, interference and loss, and from unauthorised access, modification or disclosure.
     

While we strive for data security, we note that no data transmission over the internet can be guaranteed to be entirely secure.

WHY WE COLLECT, HOLD AND USE YOUR PERSONAL INFORMATION
We collect, hold, use and disclose Personal Information for various purposes, including:

  1. providing services to you or receiving goods or services from you;

  2. facilitating other interactions with you in the course of operating our business;

  3. payment, billing and debt collection purposes;

  4. communicating with you;

  5. responding to your enquiries and information requests;

  6. assessing the performance of aspects of our business;

  7. conducting business processing functions;

  8. storing information at third-party data centres;

  9. administrative, marketing, planning, treatment or service development, quality control and research purposes;

  11. complying with our tax and legal obligations;

  13. applying for and maintaining required or desired accreditations and adhering to internal or external audit and compliance obligations;

  14. credit/creditworthiness verification, preventing or identifying fraud and in engaging in transactions;

  15. employing staff, including conducting criminal reference checks, reviewing relevant medical history, and other background checks permitted by law; and

  16. any other uses identified or reasonably inferred at the time of its collection.
     

We may disclose your Personal Information to such persons as is necessary to achieve the above purposes. This will often include disclosure to our related bodies corporate, employees, contractors or other third party service providers. We will only ever disclose Personal Information parties who are not a part of PTG Group, particularly Sensitive Information, when appropriate to achieve genuine and legitimate business purposes, or if required by law. Where appropriate and possible, we will endeavour to de-identify data before disclosing.
 
We may use or disclose Personal Information for secondary purposes where it would be reasonable to expect us to do so, and that secondary purpose is related (or directly related in the case of Sensitive Information) to the primary purpose.
 
OVERSEAS DISCLOSURE
We may disclose Personal Information to third parties overseas for the purposes for which we collect and use that information. This will generally be limited to third party providers of services such as payment processing, website hosting, data storage, electronic communications and data analysis. Any such disclosure will be done in accordance with the Act.
 
We will attempt to ensure that persons to whom the disclosed Personal Information relates have comparable rights in relation to that information once disclosed overseas.
 
HOW TO ACCESS AND CORRECT YOUR PERSONAL INFORMATION?
We will endeavour to keep your personal information accurate, complete and up to date, other than where it is only collected to provide a service or advice in respect of a particular point in time, in which case we will seek to ensure it is accurate, complete and relevant as at that particular point in time.
 
If you wish to make a request to access and/or correct the Personal Information we hold about you, you should make a request by contacting us and we will respond within a reasonable period, usually within 30 days.  We may require proof of your identity and full details of your request before we update your Personal Information.
 
If we refuse a request to access or correct Personal Information, where reasonable, we will provide our reasons for doing so and information about your ability to lodge a complaint about such refusal.
 
HOW DO WE PROTECT PERSONAL INFORMATION?
We will take reasonable steps to ensure that the Personal Information that we hold about you is kept confidential and secure, including by:

  1. Having a robust physical security of our premises and databases/records;

  2. Taking measures to restrict access to only personnel who need that Personal Information to effectively provide services to you; and

  3. Having technological measures in place (for example, multifactor authentication, anti-virus software, fire walls).
